So called “economic development” bills move to the House of Representatives.

Although we have made great headway, these bills are still bad and need to be killed. Most of the China Hub bill was gutted in the Senate, but there is still plenty of unconstitutional subsidy left in it. What’s more, the House can add any or all of the original language back in.

The MOSIRA bill may be as bad as ever. It opens a door for public subsidy for private research, and that’s bad enough, but there’s potential for subsidizing the destruction of human embryos and cloning research, too.

The Votes Are In!
Please take note of the senators, who chose to ignore the Constitution. The $300 million for the China Hub was removed from the bill, but there were still other unconstitutional provisions in the bill. As we noted earlier, many legislators are not willing to stand firmly and totally on the side of the Constitution and the free market. Be forewarned that the House is expected to put the $300 million tax credit for the China Hub back into the bill. Now is the time to call your state representatives.
The following State Senators voted to act against the Missouri Constitution by awarding public money in the form of tax credits and subsidies. (SB8) Please remember this during the next election cycle and encourage primaries in your area to put constitutional conservatives in office.

Update on the Special Session

Achieving a partial victory is often times all the further some legislators will take an issue, see Ron Calzone’s report for information on how to proceed to a full victory. Unconstitutional is unconstitutional, and we need to send a message that we expect nothing less than adherence to the Constituion.

The senate took up the “China Hub Bill” (SB 8) Tuesday and amended it as follows:

  • Removed the subsidies for the importation of Chinese products. This is good, but other aspects of the trade with China were left in, like subsidies for exporting America goods to China. These subsidies are still unconstitutional and pick winners and loser.
  • Removed the elimination of the “circuit breaker” tax credit for poor renters. This was supposed to save taxpayers several hundred million dollars over 15 years.
  • The bill still contains various other unconstitutional targeted tax subsidies.

Although the single most offensive part has been removed, This is still an unconstitutional bill. And as long as the bill is alive, the China Hub language can be put back in by the House of Representatives or in Conference Committee!!

Tuesday, the senate also “perfected” SB 7, the MOSIRA bill.

It has unconstitutional provisions for subsidizing “life sciences research”. Hoped for pro-life language to prevent the use of public funds to embryonic stem cell and cloning research was watered down with an amendment by Sen. Bob Dixon. This bill should also be killed in the senate!

Please call you senator and ask him to vote NO on both these bills! (Senate contact info)

Please call the following senators and tell them SB 8 is just as unconstitutional without the China Hub language as it was with it. Tell them no amount of proposed future savings is worth violating their oath of office for!

Tell them SB 7 is just as bad, or worse, than SB 8.

Ask them to filibuster these bills until they’re dead and tell them you’ll back them up!

Once again,we must thank Ron Calzone for his ongoing presence in Jefferson City. The following email message from Ron updates the current situation on the China Hub Bill. Please continue your calls, and if possible, a visit to your State Senator’s office expressing your disapproval would carry a strong and powerful message that Missourians are fed up with backroom politics. Don’t forget to support the legislators, who are standing against this boondoggle.

The following message was received by all who filled out the witness form:

Thank you for filling out a witness form in opposition to the Tax Credits and other subsidies which permeate the China Hub bill.

I can assure you that you voice was heard! After all, your voice was in unison and, therefore, amplified by the other 750 Missourians who also filled out witness forms! (Almost 800 witness forms were filled out, but some were too late to make the hearing.)

Both the committee and the press were impressed when we plopped a 5” stack of “citizen input” on the railing separating the lawmakers from the People in that hearing room.

That, along with the hard work of patriots from around the state, produced results, and I’m happy to report that we’ve won Round 1 in this battle against the subversion of basic constitutional principles and subversion of free market principles.

Senate leadership decided to postpone debate on the China Hub bill until Tuesday, September 13. I think we have them on the run.

Their plans had been to pass it in the Senate and start the process in the House by the 9th.

The most exciting news is the development of a strong core team of senators committed to using the powerful tool of a filibuster. These men are planning to live up to their pledge to support and defend the Constitution and interpose on your behalf.

Timeline of Events

Tuesday

  • Senate convened at about noon. Sen. Crowell slows the process with an unusual parliamentary maneuver – filibustering the approval of a resolution that informs the House that the Senate is in session.

  • SB 2 and SB 3 are introduced by Sen. Purgason. SB 2 is the compromise bill from leadership of the House, Senate and Governor. Purgason had been asked to carry the bill although he hadn’t been included in the drafting process or negotiations. SB 3 is Purgason’s own version, with aggressive cuts to exiting Tax Credits. Leadership begins to realize their version is going to get some competition from the very guy they chose to handle it.

  • The Senate recesses for the afternoon and plan to reconvene later that evening.

  • Upon reconvening, SB 7 and SB 8 are introduced by Sen. Mayer. He intends to split MOSIRA (now SB 7) from the China Hub and other subsidy provisions (SB 8) and reduce his dependency on Purgason.

  • A hearing is scheduled for SB 2, SB 7 and SB 8 “upon adjournment” the following morning.

  • We register a complaint to Pro tem Mayer over the short cycling of the normal 24 hour hearing notice.

  • To Sen. Mayer ‘s credit, he reschedules the hearing for 7:30 pm Wednesday, about 24 hours after the bills were introduced.

Wednesday

  • In the morning session SB 2, 3, 7 & 8, among others, were second read.

  • The Senate was declared in recess until 9:00 pm that evening

  • At 7:30 pm the hearings for SB 8 & SB 7 began. Numerous witness in favor of the bill testified and many patriots were present to testify against the bill. The crowd filled the Senate Lounge and spilled out into the hall, where a remote monitor was set up.

  • After several witnesses for the bill, the committee chair began alternating 3 proponents and 3 opponents because he knew he would run out of time.

  • The first opponent presented the committee with over 750 witness forms from citizens in opposition.

  • Opponents pointed out that targeted tax credits and subsidies are unconstitutional and pointed out supreme court cases supporting that contention.

  • Opponents also expressed concern that the process was being rushed beyond the senators’ ability to read and understand the bills they were expected to vote on.

  • After SB 8 was heard, the committee took up SB 7.

  • In executive session SB 8 was voted “do pass” with Sens. Nieves and Ridgeway voting no.

  • SB 7 was also voted “do pass” with Nieves as the sole dissenting vote.

  • The senate reconvened at a very late hour and since most of the senators had gone home during the hearing, they lacked a quorum.

  • After a struggle to be recognized by the pro tem, Sen. Crowell demanded a roll call quorum call. It took over an hour to wake sleeping senators and get 19 of them back in the chamber. Tempers flared and at least one shouting match ensued.

  • It seems that proceedings of the week diminished the cooperative spirit of the senate.

Thursday

  • The senate reconvened at 9:00 am

  • Leadership announced that they would not take up the bills until Tuesday morning, giving the senate the long weekend to read and familiarize themselves with the bills.

It should be noted that the bill that was supposed to be over half passed by Friday is only just beginning a long hard battle the following Tuesday. The involvement of pesky patriot citizens has slowed the process – hopefully to an extent that will allow true deliberation and honest evaluation of the proposals.

Urgent – Call Your Missouri Senators and Representatives NOW!

Last week we issued a Liberty Alert calling attention to an upcoming Special Session of the Missouri General Assembly, which convened today. The Governor and many GOP legislators are promoting a special interest deal that will benefit China and certain groups of investors, then deceptively identifying the legislation as a jobs creation bill. A Special Report on the Special Session of the Missouri General Assembly

A bill that will set up a “China Hub” in the St. Louis area and provide $360,000,000 in taxpayers’ subsidies will be considered by the Missouri legislature this week.

This bill subverts the constitutional role of government and destroys liberty – we need your help to fight it.
The Governor and leaders of both the House and Senate agreed to the terms before calling for a special session of the legislature. This bill is on a fast track and we must act decisively.
The bill has been called “Aerotropolis”. Governor Jay Nixon recently renamed it the “Missouri Jobs Act”. Others, who understand the true nature of bill, are calling it “Errortropolis” or the “Jobs for China Act”. In spite of the great job of deceptive branding, this special interest bill will likely benefit communist owned Chinese Airlines and manufacturing companies more than Missouri workers. Of course, a few Missouri developers will clean up, too, as unnecessary infrastructure is built – largely on the taxpayers’ backs.

Here is a preview of what is said to be in the bill so far. (They haven’t finished writing it.)

  • 300 million dollars in transferable tax credits to a small group of developers in St Louis who are to build warehouse space around Lambert airport. (These tax credits ARE NOT simple tax cuts – they are as good as cash subsidies.) The money is to be doled out by the mayor of St. Louis and the St. Louis County executive.
  • 60 million dollars in subsides to freight forwarders, ostensibly to encourage Missouri exports.
  • Takes away 50 to 100 million dollars per year in tax credits for low income renters and elderly provided an equal amount be spent on senior citizen programs.
  • State funded venture capital programs for business startups.
  • There are also promises to sunset or otherwise reduce existing tax credits over the next decade. Currently, the reported cuts are less than the new tax credits. The promise of these “cuts” is deceiving, much like the baseline budget cuts of the federal debt ceiling increase.
  • There is surely a lot more in the bill. Last we heard it had ballooned to several hundred pages and the head of the Missouri Chamber of Commerce says it has “Something for everyone.” so he is optimistic it will pass.
  • This anti-free-market bill also includes subsidies to lure sporting events and film-making to Missouri.

There are several reasons to oppose this legislation.

  • First and foremost, it is against economic freedom. Government should not choose the winners and losers in Missouri. Subsidies to one person or business always takes away opportunity from others.
  • This sort of special subsidy violates several constitutional principles and specific clauses forbidding the enactment of “special laws” which target only certain entities or locales. It also violates a Missouri constitutional prohibition of grants of public money to private parties.
  • This is Soviet style central planning rather than free markets. That economic model was tried and failed miserably in Russia and Germany. Closer to home, there is an airport on the east side of St Louis built just for this purpose; international air cargo. After over 300 million taxpayers dollars and more than 12 years, that airport has one flight per week of cargo and 0 passenger flights.   • This bill allows special interests to subvert the purpose of government. As long as we continue to allow government to redistribute wealth and provide special favors – all on the backs of the People – those special interests will control the legislative process, and do so with money they get from taxpayers! Legislators bought by the special interests will not have your interest at heart – that results in liberty-stealing laws of all sorts.
  • This bill will result in unforeseen consequences. St Louis already has an abundance of empty warehouse space for rent. Now our Government thinks the solution is to build more and subsidize it with your tax dollars? Because this project is not market driven, it will result in misallocation of resources. The subsidies will also harm other employers, who must compete for available labor and capitol – that ultimately hurts even the average worker.
